Welcome to LPeso ("we", "our", or "the Company"), a loan service provided by SINGULARITY LENDING INC. (SEC Registration No. 2021060015436-59, Certificate of Authority No. L-21-0007-15). These Terms and Conditions ("Terms") govern your access to and use of our mobile application, official website (https://www.lpeso-mic.com), and related services (collectively, the "Services") provided in the Republic of the Philippines. Please read them carefully.

By downloading, accessing, or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of our Services.

1. Eligibility

To use our Services, you must:

  • Be at least 18 years old;
  • Possess legal capacity to enter into a binding agreement;
  • Reside in the Philippines and provide valid and verifiable identification (e.g., a government-issued ID).

We reserve the right to deny or terminate access to any user who does not meet these requirements.

2. Services Provided

Our Services primarily include but are not limited to:

  • Facilitating access to short-term personal loan products;
  • Enabling loan applications, disbursements, and repayments through our mobile app;
  • Providing credit assessment based on user-submitted data and third-party information (e.g., credit bureaus).

Please note that we are not a bank. Loan services are offered subject to approval and eligibility criteria.

3. User Obligations

As a user, you agree to:

  • Provide truthful, complete, and up-to-date information during registration and loan application;
  • Use the Services only for lawful purposes;
  • Not engage in fraudulent or harmful activities (e.g., providing false information or attempting to manipulate the system);
  • Keep your login credentials confidential and notify us immediately of any unauthorized access;
  • Not share your account with third parties or allow others to use it on your behalf.

Any misuse of the platform may result in the suspension or permanent termination of your access.

4. Privacy and Data Use

We are committed to protecting your personal data in accordance with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173) and other applicable laws. By using our Services, you consent to the collection, use, storage, and sharing of your personal data as described in our Privacy Policy.

Your data may be shared with licensed credit bureaus, regulatory authorities (e.g., Securities and Exchange Commission of the Philippines), or authorized third-party partners where necessary for service delivery, verification, or legal compliance.

5. Loan Terms

When you apply for and are approved for a loan through our app:

  • You will be presented with a clear breakdown of the principal, interest rate, repayment schedule, and any applicable fees;
  • You must repay the loan according to the agreed terms;
  • Late payments may attract penalties, impact your credit rating, or result in collection actions.

We reserve the right to assign or transfer your loan account to third-party collection agencies in case of default.

6. Fees and Charges

There may be service-related fees, such as:

  • Processing or disbursement fees;
  • Penalties for delayed payments;
  • Charges associated with repayment extensions or restructuring.

All applicable fees will be disclosed in advance during the loan application process. You can also view the fee schedule on our website (https://www.lpeso-mic.com/fees).

7. Intellectual Property

All content provided through our Services, including logos, text, graphics, and software, is the property of SINGULARITY LENDING INC. or our licensors and is protected by Philippine intellectual property laws, including the Intellectual Property Code of the Philippines (Republic Act No. 8293).

Users are not permitted to copy, reproduce, modify, or distribute any part of our Services without prior written permission.

8. Suspension or Termination of Service

We reserve the right to suspend or terminate your account or restrict your access to the Services at our sole discretion, especially in cases of:

  • Misuse or abuse of the Services;
  • Breach of these Terms;
  • Suspected fraudulent activity;
  • Non-payment of loans or failure to comply with repayment terms.

We will notify you of such actions where feasible, via email, WhatsApp, or in-app notifications.

9. Limitation of Liability

We shall not be liable for:

  • Any losses resulting from your failure to comply with these Terms;
  • Delays or failures in Service delivery caused by external factors beyond our control (e.g., mobile network issues, third-party system failures, or force majeure events);
  • Any indirect, incidental, or consequential damages arising from your use of the Services.

Our total liability shall not exceed the amount you have paid us (if any) for the use of the Services, subject to applicable laws.

10. Modifications to Terms

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Last updated" date and notify you via the App, website, email, or WhatsApp. Continued use of the Services after any such changes constitutes acceptance of the revised Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

In case of any dispute, we encourage users to first contact our customer service for resolution. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts in Alabang, Philippines.
